게으른 자의 바 등록기(1) - 무엇을 해야 할지 알아보자

지난 주에 나보다 늦게 유학 다녀온 친구가, 프로보노 다했냐고, 너가 예전에 한 프로보노로도 충분히 인정받을 수 있는 것 알고 있냐고 물었다. (1) 우선 현재 진행 중인 프로보노 프로젝트가 5월에 마무리되고, (2) 오! 과거 프로보노까지 추가인지는 몰랐는데라고 생각을 한 후, 아직 아니라고 답을 했다. 친구가 그 다음 step이 무엇인지 알고 있냐고 해서 먼저 Bar admission 절차를 끝낸 친구들에게 물어물어 서류를 받았다.

 

나는 3rd department로 배정을 받았는데, 원 주소지가 해외이면 3rd dep으로 배정을 받는다고 한다. 원래 본가 주소로 등록해놓고 바꾸지를 않아서 3rd dep이다. 거의 핑거프린세스(ㅠㅠ) 수준으로 친구 2명에게 어떻게 하면 되냐고 물었는데 착한 친구들이 모든 것을 말해주었다.

각종 서식 중에 application for admission은 Notary public 앞에서 공증을 받아야 한다.  (참고: https://nycourts.gov/ad3/admissions/docs/JoinStatementExecuted.pdf)

 

바 등록 서류 리스트는 다음과 같다.  각 division 별로 서류 양식이 다른 것도 같은데, 해당 department에서 요구하는 형식으로 하면 된다고 함.

 

(1) copy of the letter or notice of certification from the State Board of Law Examiners - 시험 다 합격하고 나면 레터 받는데, 그 레터를 가장 먼저 내야 함.

 

(2) application for admission questionnaire - 이거 원본 내야 하고, 공증 받아야 함.

이 서류는 내가 작성하는 서류이고, 이 부분은 공증을 받아야 함. 내가 작성하기 때문임

 

여기 중간에 로스쿨 어디 나왔는지 쓰는 부분이 있는데, 미국 로스쿨 쓰면 되고 미국 로스쿨에 성적표 보내라고 또 보내야함. 아주 귀찮아짐.....(ㅠㅠ). 분명 학교 다닐 때도 미국 로스쿨에서 성적표 처리를 해주었는데, 그 부분은 eligibility 증명용에 불과했다고 한다.

 

(3) two original affirmations of good moral character

이 서류는 내가 멀쩡한 사람임을 증명하는 서류인데, 다른 사람이 작성하여야 하고 공증을 받지 않아도 됨. 그 사람이 작성해서 지원자한테 주면, 지원자가 취합해서 제출하는 시스템임. 

 

Applicant must submit two (2) original good moral character affirmations as part of an application for admission (see 22 NYCRR 520.12). The affirmations should be completed by reputable persons who have known applicant for not less than two years. The affirmations should not be completed by persons who also complete employment affirmations on applicant’s behalf. The affirmations should not be completed by persons associated with applicant’s present employer or persons related to applicant by blood or marriage or by other applicants or by members of the faculty or administrative staff of any law school attended by applicant. Preferably, one affirmation should be completed by an attorney in good standing. The person completing the affirmation should return it to the applicant, who should file it with and at the same time as the application for admission questionnaire.

 

- 2년 이상 알고 지낸 평판이 좋은 사람이 작성

- 고용 확인서를 작성한 사람, 혈연관계나 결혼한 사람, 다른 지원자(같은 bar 시험 본 사람), 지원자가 다닌 로스쿨의 교원이나 직원은 작성할 수 없음. 

- 1개는 가급적 변호사에게 받길 바람 

 

(4) original employment affirmations or letters

이직 많이 했으면 복잡해짐.  고용관계를 모두 기재하는 서류임.

 

(5) original certificates of good standing and grievance letters from jurisdictions in which you have been admitted to practice

- 대한 변협에 certificate of good standing 신청해서 받아야 함. 영어로...

 

(6) original pro bono affidavit 

 

(7) original affidavit regarding skills competency and professional values requirement

 

일을 충분히 했음을 보여야 함.  미국 이외 지역에서 full time으로 1년 또는 part time으로 2년 일했으면 충족됨.  고로 한국 변호사들은 통상 문제 없이 충족됨.
